These Terms of Service ("Terms") govern your access to and use of the Sourcream.ai platform, website, and related services (collectively, the "Service") operated by Sourcream.ai Pty Ltd, located in Chatswood, NSW, Australia ("we", "us", "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement. By using the Service on behalf of a company or organisation, you represent that you have the authority to bind that entity to these Terms.

2. Account Registration

To access certain features, you must create an account. You agree to provide accurate, current, and complete information and to keep your account credentials confidential. You are responsible for all activity under your account.

3. Subscription Plans and Payment

The Service is offered on a subscription basis with tiered pricing (Starter, Business, Pro, Agency). All fees are quoted in Australian Dollars (AUD) unless otherwise stated. Payments are processed via Stripe. Subscriptions auto-renew at the end of each billing period unless cancelled before the renewal date.

4. Use of the Service

You agree to use the Service only for lawful purposes and in compliance with all applicable laws. You shall not: (a) reverse-engineer, decompile, or disassemble the Service; (b) use the Service to collect, store, or process personal data in violation of applicable privacy laws; (c) attempt to interfere with the Service's infrastructure or security; (d) resell or sublicense the Service without our written consent.

5. Intellectual Property

All content, code, designs, trademarks, and data comprising the Service are the exclusive property of Sourcream.ai Pty Ltd. You retain ownership of any data you upload to the Service. By using the Service, you grant us a limited licence to process your data solely for the purpose of providing the Service.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We comply with the Australian Privacy Principles (APP) under the Privacy Act 1988 (Cth).

7. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable notice. We are not liable for downtime caused by circumstances beyond our reasonable control.

8. Limitation of Liability

To the maximum extent permitted by law, Sourcream.ai shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.

9. Termination

Either party may terminate the agreement at any time. You may cancel your subscription through your account dashboard. We may suspend or terminate your access if you breach these Terms. Upon termination, your right to use the Service ceases immediately.

10. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be resolved in the courts of New South Wales.

11. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded, restricted, or modified by agreement.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or an in-app notification at least 14 days before taking effect. Continued use of the Service after such changes constitutes acceptance.

Sourcream.ai Pty Ltd ("we", "us", "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our website and platform (the "Service").

1. Information We Collect

Account Information: When you register, we collect your name, email address, company name, and billing details (processed securely via Stripe; we do not store credit card numbers).

Usage Data: We collect information about how you interact with the Service, including pages visited, features used, and session duration.

Tracking Data (on behalf of our customers): The Sourcream tracking script collects non-PII attribution data from your website visitors, including: page URL, referral URL, UTM parameters, browser type, and timestamp. This data is used solely for marketing attribution and is stored in association with your account.

2. How We Use Your Information

We use the information we collect to: (a) provide and maintain the Service; (b) process subscriptions and payments; (c) communicate with you about your account, updates, and support; (d) improve the Service through analytics and feedback; (e) comply with legal obligations.

3. Data Storage and Security

All data is stored on Amazon Web Services (AWS) infrastructure located in Sydney, Australia. We implement industry standard security measures including encryption in transit (TLS 1.2+), encryption at rest, two-factor authentication, and regular security audits.

4. Cookies and Tracking Technologies

Our website uses essential first-party cookies only for session management and authentication. We do not use third-party advertising cookies. The Sourcream tracking script installed on customer websites operates server-side and does not place third-party cookies on end-user browsers.

5. Third-Party Services

We use the following third-party services: Stripe (payment processing), AWS (cloud infrastructure), and Google Analytics 4 (website analytics for our own marketing site, with IP anonymisation enabled). We do not sell your personal information to third parties.

6. Data Retention

We retain your account information for as long as your account is active. Attribution data collected via the tracking script is retained for a maximum of 24 months. Upon account deletion, all associated data is permanently removed within 30 days.

7. Your Rights

Under the Australian Privacy Principles and applicable privacy laws, you have the right to: access the personal information we hold about you; request correction of inaccurate information; request deletion of your data; withdraw consent for data processing; and lodge a complaint with the Office of the Australian Information Commissioner (OAIC).

8. International Data Transfers

While our primary infrastructure is in Australia, some third-party services may process data internationally. We ensure appropriate safeguards are in place for any cross-border data transfers in compliance with the Privacy Act 1988.

9. Children's Privacy

The Service is not intended for individuals under the age of 18. We do not knowingly collect personal information from children.

10. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes via email or in-app notification. The "Last Updated" date at the top reflects the most recent revision.

14 Day Satisfaction Guarantee

All new paid subscriptions come with a 14 day satisfaction guarantee. If you are not satisfied with the Service within the first 14 days of your paid subscription, you may request a full pro-rated refund by contacting us at hello@sourcream.ai.

Cancellation

You may cancel your subscription at any time through your account dashboard. Upon cancellation, your access to the Service will continue until the end of the current billing period. No refunds are issued for partial billing periods after the initial 14 day guarantee window.

Annual Plans

Annual subscriptions may be refunded on a pro-rated basis within the first 30 days. After 30 days, no refunds are available for annual plans, but you may cancel to prevent auto-renewal.

Australian Consumer Law

This refund policy does not limit or exclude any rights you may have under the Australian Consumer Law. If the Service has a major failure, you are entitled to a refund or replacement as prescribed by law.
